NNGMS & Cloud-Based Email Services Terms and Conditions

These terms serve as a legally binding agreement between parties, establishing the parameters for usage, obligations, and potential consequences. It is crucial for users or customers to carefully review and understand these terms before proceeding

Service Overview

This agreement governs the combined Email (NNGMS) and spam protection (SpamExpert) services (“Bundle”) provided by “Nexus” to the “Customer”.

Eligibility & Restrictions

  • Only one bundle per domain.
  • Marketing, bulk, or unsolicited emails are strictly prohibited. Violation may lead to suspension or termination.
  • Domains on spam/RBL lists (e.g., SBL, XBL, APWG, etc.) won’t be processed and may be suspended if listed later.

Plan Upgrade & Downgrade

  • Upgrades are allowed.
  • Downgrades are not permitted.

Billing & Payments

  • All services are prepaid; invoices must be cleared in advance to avail services.
  • No refunds on prepaid services, including partial months.

Term & Cancellation

  • Services require written cancellation, with at least 1-month prior notice.
  • Post-cancellation, the domain and data may be retained for one week before permanent deletion.
  • Provider may terminate immediately for policy violations or non-payment.

Backups & Restorations

  • Weekly backups are included.
  • in spam experts outgoing mail service, the backup will be managed from the client side on outlook.
  • Restoration beyond that is available for a fee, as an add-on.

Customer Responsibilities

  • Provide accurate, up-to-date contact and billing information.
  • Maintain local copies (e.g. on email client) as backup.
  • Use a valid sender address to avoid issues with bounce handling.

Support & Availability

  • 24/7 support via ticket, email, phone
  • 99.9% uptime guaranteed.

Security Features

  • Includes branded SSL, greylisting, synchronization, auto-responders, and mailing list management.
  • Messages must not contain malicious content or violate acceptable use.

Limitations of Liability

  • No liability for data loss post-termination or suspension.
  • Provider not responsible for backup of application or website data—only email system backups apply.
  • Spam expert doesn’t have mailboxes limitations or disk utilization limitations.

  • All disputes governed in accordance with [applicable jurisdiction].
