Development Terms & Conditions

Agreed advance payment(full or partial) is must for the initiation of project. In case the customer fails to pay within the desired time then the order will be considered cancelled as, there will be no initiation of project without paid invoice.

Terms & Conditions

Scope of Services:

The bundle package includes website development services as specified in the proposal. The package includes a free domain registration for one year and free hosting for one year

Payment Terms:

The customer agrees to make full payment for the selected product/ package before the project begins. Failure to make the payment within the specified timeframe may result in project delays

Project Timeline:

The customer understands and agrees that the website development project will be completed within the provided timeline from the date of payment

Domain and Hosting:

The customer acknowledges that the free domain registration and hosting are valid for one year from the project start date (FOR BUNDLE PACKAGES). After one year, the customer is responsible for renewing the domain and hosting services at their own cost.

Content and Materials:

The customer is responsible for providing all necessary content, images, and materials required for the website development. Any delay in providing content may impact the project timeline & budget.

Revisions and Changes:

The customer is entitled to a reasonable number of revisions and changes during the development process. Additional revisions beyond the agreed-upon scope may incur extra charges.

Ownership and Rights:

Upon full payment, the customer will own the rights to the website design and content. The developer may retain the right to showcase the project in their portfolio.

Cancellation:

If the customer decides to cancel the project before completion, any payments made are non-refundable.

Maintenance and Support:

The customer may opt for a maintenance and support plan after the initial development, which will be billed separately on monthly or quarterly basis.

Legal Compliance:

The customer is responsible for ensuring that the website complies with all applicable laws and regulations. The developer is not liable for any legal issues arising from the content or use of the website.

Confidentiality:

Both parties agree to keep confidential any proprietary or sensitive information shared during the project.

Client Responsiveness:

Delays from the client side may impact the timeline and could result in additional costs. The client is expected to respond to requests for feedback, approvals, or information within 24 hours.

Communication Channels:

All official communication regarding the project will be conducted through agreed-upon channels.

Copyright:

The Client retains all rights, including copyright and intellectual property rights, to any content they provide.

Project Termination & Delays:

If the Client fails to respond to communication for a period of seven consecutive days, despite reasonable follow-up attempts, the project may be placed on hold or terminated. If the project is delayed by more than fourteen days due to clients expanded requirements beyond the original scope the Service Provider reserves the right to Provide a revised quote or invoice reflecting the additional time.

Terms & Conditions

  1. Payment will be non-refundable & non-negotiable once agreed.
  2. Client will provide content and maximum material along Logo to Sales Staff to proceed further with the Website development.
  3. In case of Logo Designing, additional services cost will be added to the locked solution.
  4. Any delay from client side regarding content provisioning, communication & feedback will have a direct impact on project timeline. So after exceeding 7 working days, additional service charges will be incurred to proceed further with the project.
    Please Note: Portfolio Website development is a one-time project within a constant time frame so, any extension in timeline will affect the project budget as well.
  5. In case Customer wants to opt any other services then respective payment for the selected package will be charged accordingly.
  6. For recurring services client will need to pay on monthly or quarterly basis.
  7. In case of an informed delay due to valid reason(s), Nexus will hold the services and keep all credentials and rights preserved for a period of 30 days. After that Nexus will no longer be responsible for any data regarding Client’s website.
  8. Selected package with agreed project scope are not negotiable.
    Please Note: Any other feature, module outside the provided and selected template will not be entertained in agreed solution.

Terms & Conditions for Ecommerce & Enterprise Packages

  1. If number of pages exceeds the given limit, additional pages will be charged as an additional work.
  2. Any feature that is not mentioned in Project Scope will be charged separately.
  3. Completion time only includes working days. (weekend and public holidays excluded)
  4. Any query/change request made via telephone will not be honoured until and unless confirmed in writing via email
  5. Nexus cannot accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website have been designed and handed over to the Client.
  6. If the Client’s website is to be installed on a third-party server, Nexus must be granted temporary read/write access to the Client’s storage directories which must be accessible via FTP/cPanel.
  7. Essential content including text and specific images is to be supplied by the Client prior to commencement of development. Delays in delivery of content will extend time taken to complete the development.
  8. All the content provided by the client shall remain the sole property of client, and client shall be the sole owner of all rights in connection therewith.
  9. Client is responsible for complying with all relevant laws relating to e-commerce, and defend and indemnify Nexus from any claim, penalty, taxes, tariff loss or damage arising from your or your clients’ use of Internet electronic commerce.
  10. We are more than happy to offer you the opportunity to make revisions to the design. However, we have the right to limit the number of design proposals to a reasonable amount and may charge for additional designs if you make a change to the original design specification.
  11. Both parties may cancel web development service at any time by giving at least 1-week prior notice in written through authorized / registered email ID.
  12. If Agreement is terminated by any party (Clients or Nexus) prior to completion of the website, a calculation on work completed and unbilled will be made, including all work in progress and this payment is required to be paid by the Client within seven (7) days.
  13. Nexus reserves the right to decline further work on a project if there are invoices outstanding at Client side.
  14. Nexus is not responsible for errors on third party software(s).
  15. Nexus will keep a copy of the site and design source files when a website project is being worked on. However, the Client agrees that it is their responsibility to have regular backups made by themselves or the third party hosting services in case of a software or hardware failure at the third party hosting servers.
  16. All fees quoted for projects exclude web hosting, domain name registration, copywriting, stock imagery, font licenses, liaising/setting up hosting or email, purchasing of third party plugins, or any other conditions outlined in the proposal document.

Cancellation Policy

  1. Nexus Technologies reserves the right to cancel any project if the Client’s Focal person didn’t contact Nexus team or fail to clear their dues within 1 month of Project timeline. In that case, any payment made by the Client earlier will be Non-refundable and Nexus will not remain liable to deliver the product.
  2. Any extension in Project timeline will be charged as 10% of the actual amount on per week basis.

Payment Policy

  1. 50% Advance payment after signing agreement (Nonrefundable).
  2. 40% After design approval (Nonrefundable).
  3. 10% After User Approval and Before Website launch (Nonrefundable).
